1. Definitions

"Service" refers to the website located at dice83.com, all associated pages, tools, APIs, and content provided by the Operator. "Operator" refers to the legal entity identified on the Impressum page. "User" or "you" refers to any individual or entity accessing or using the Service. "Content" refers to all text, code, graphics, designs, algorithms, visual output, documentation, and other materials available through the Service.

2. Description of Service

dice83.com provides browser-based random generation tools for informational, educational, and entertainment purposes. The Service includes random number generators, dice rollers, password generators, color palette tools, generative art tools, and related utilities. All randomness generation occurs entirely within the User's web browser using the Web Cryptography API. The Operator's server delivers page content and rendering algorithms. The server does not generate, process, store, or transmit random results or User data.

3. Acceptance and Eligibility

By accessing the Service, you represent that you have the legal capacity to enter into these Terms. If you are accessing the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. Users under the age of 16 should obtain consent from a parent or legal guardian before using the Service. The Operator does not knowingly collect personal information from anyone, including minors, as described in the Privacy Policy.

4. Service Provided "As Is"

To the fullest extent permitted by applicable law, the Operator expressly disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and completeness. No advice or information, whether oral or written, obtained from the Operator or through the Service creates any warranty beyond what is expressly stated in these Terms.

The Operator does not warrant that: (a) the Service will meet your specific requirements; (b) results obtained through the Service will be accurate, reliable, or suitable for any particular application; (c) the quality of any tools, content, or output will meet your expectations; or (d) errors or defects in the Service will be corrected.

5. Randomness and Statistical Properties

The Service uses the Web Cryptography API (crypto.getRandomValues()) as its entropy source, which draws from hardware-level randomness provided by the User's device and operating system. The Operator does not control, monitor, or guarantee the entropy quality of any individual User's device or browser implementation. The Fairness page describes the technical approach. It does not constitute a warranty or guarantee of specific statistical properties for any particular use case.

Results generated by the Service are intended for general-purpose informational and entertainment use. The Service is expressly unsuitable and must not be used as the sole source of randomness for applications requiring certified or audited randomness, including cryptographic key generation for production systems, scientific research requiring reproducible certified entropy, regulatory compliance processes, or any application where the failure of randomness could result in financial loss, personal injury, or legal liability.

6. Limitation of Liability

This limitation applies regardless of the legal theory on which the claim is based, including breach of contract, tort (including negligence), strict liability, or any other basis, and whether or not the Operator has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the Operator's liability shall be limited to the maximum extent permitted by law.

In all cases, the Operator's total cumulative liability arising from or related to these Terms or the Service shall not exceed the amount you have paid to the Operator for use of the Service during the twelve (12) months preceding the claim. As the Service is provided free of charge, this amount is zero (EUR 0.00).

7. Indemnification

You agree to indemnify, defend, and hold harmless the Operator, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you generate, distribute, or make available using output from the Service.

8. Intellectual Property

The Service, including its source code, algorithms, design, visual identity, documentation, educational content, and the dice83 name and logo, constitutes proprietary intellectual property of the Operator and is protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership interest to you.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. Random results generated by the Service through your browser belong to you. The tools and algorithms that produce those results remain the property of the Operator.

9. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service for any purpose that violates applicable local, national, or international law or regulation.
• Attempt to gain unauthorized access to any portion of the Service, related systems, or networks.
• Use automated scripts, bots, or scrapers to access the Service at a rate or volume that degrades the experience for other Users or imposes an unreasonable load on the infrastructure.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent that applicable law expressly permits such activity.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or on the Service.
• Use the Service in connection with any illegal activity, including any form of unauthorized or unlicensed activity in your jurisdiction.
• Frame, mirror, or create derivative works based on the Service without prior written consent from the Operator.

10. Client-Side Architecture and Privacy

The Service operates on a client-side computation model. The Operator's server delivers page content, metadata, and rendering algorithms. All random generation, result display, and user interaction processing occurs within your browser. The Operator does not receive, log, store, or have access to your generated results, roll history, preferences, or any other data produced during your use of the Service. Data stored in your browser's localStorage (such as session statistics and preferences) is under your sole control. The Operator has no ability to access, modify, recover, or delete this data. Clearing your browser data removes it permanently.

11. Third-Party Services and Content

The Service may load resources from third-party content delivery networks (such as Bootstrap CSS and JavaScript frameworks). These third-party services are governed by their own terms and privacy policies. The Operator does not control and assumes no responsibility for the content, privacy practices, or availability of third-party services.

The Service may contain links to external websites for educational or reference purposes. The inclusion of any link does not imply endorsement, sponsorship, or affiliation. The Operator is not responsible for the content or practices of linked external sites.

12. Service Availability and Modification

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws applicable to the Operator's jurisdiction as identified on the Impressum page, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in the Operator's jurisdiction as specified in the Impressum.
